Bailee

A person or entity that temporarily holds another person's property and is expected to care for it under the storage agreement.

A bailee is the temporary custodian of another’s property who owes a duty of care to return it as agreed.

In insurance, bailee relationships often drive responsibility language in liability, storage, and transportation coverage. The bailee must return the property in agreed condition except for covered covered-for losses.

Duty Levels

Care obligations vary by arrangement: gratuitous custody, for-hire custody, or commercial custody. Higher-risk custody often includes stricter indemnity language and separate coverage terms such as bailee’s customers insurance.

Claims Logic

When loss occurs, investigators determine whether loss was negligent, covered, excluded, or outside the bailee’s custody scope. The terms of surrender, access, and force majeure treatment matter during settlement.

Practical Example

A watchmaker holds a luxury watch for cleaning. If it is lost in the shop due to negligence, the bailee may face liability under custodial duties and trigger an insurance claim pathway tied to the custodian’s policy.
